Educator Terms and Conditions

When you sign up to become an instructor on Scholastia’s platform, you automatically agree to abide by these Educator Terms and Conditions (“Terms”). As an Educator, you are contracting directly with Scholastia.

1. Educator Responsibilities:

As an instructor, you are responsible for all content that you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements (“Submitted Content”).

You represent and warrant that:

  • your Submitted Content will not infringe or misappropriate any third party’s intellectual property rights;
  • you have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your Submitted Content and use of the Services; and
  • you will be solely responsible for the creation and development of course content, course curriculum, course material, lectures, tests etc. You will have the liberty to decide about the course syllabus, its curriculum, and all lessons.
  • you will ensure that the course is in English only (unless otherwise specified in case of language-based courses).
  • you will ensure that the course should be in the form of pre-recorded video lectures and the total length of the course should be no less than 30 hours. There is no set amount of minutes/hours allotted for each lesson but ideally all video lectures should together amount to approximately 30 hours of teaching.
  • you will provide and maintain accurate account information;
  • you own or have the necessary licenses, rights, consents, permissions, and authority to authorize Scholastia to use your Submitted Content as specified in these Terms and the Terms of Use;
  • you will ensure a quality of service that corresponds with the standards of your industry and instruction services in general.

You warrant that you will not:

  • post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content or information;
  • post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user;
  • frame or embed the Services (such as to embed a free version of a course) or otherwise circumvent the Services;
  • impersonate another person or gain unauthorized access to another person’s account;
  • interfere with or otherwise prevent other instructors from providing their services or content; or
  • abuse Scholastia resources, including support services.
  • use the Services for business other than providing tutoring, teaching, and instructional services to students;
  • engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording;

2. Educator Qualification Requirement

Since all our courses need to be fully accredited by CA Worldwide Course Accreditation, and as part of the course accreditation process, educators are required to provide a scanned copy of their qualification in the relevant subject area. This ensures that all courses meet the highest educational standards and maintain credibility.

By submitting a course for on Scholastia’s platform, the educator agrees to share the necessary qualification documents upon request. Failure to provide valid proof of qualification may result in the course not being approved for publication on our platform.

All submitted documents will be handled with confidentiality and used solely for verification purposes.

3. Course Updates and Revisions

Educators acknowledge and agree that they will need to edit and update their courses from time to time to ensure accuracy, relevance, and compliance with evolving industry standards, academic research, and institutional or regulatory requirements. Updates may include, but are not limited to, revising course content, incorporating new teaching methodologies, aligning with technological advancements, and addressing student feedback. Educators are responsible for maintaining the quality and integrity of their courses to provide an optimal learning experience.

4. License to

You grant Scholastia the rights to offer, market, and otherwise exploit your Submitted Content. This includes the right to add captions or otherwise modify Submitted Content to ensure accessibility. You also authorize Scholastia to sublicense these rights to your Submitted Content to third parties, including to students directly and through third parties such as resellers, distributors, affiliate sites, deal sites, and paid advertising on third-party platforms. We may record and use all or any part of your Submitted Content for quality control and for delivering, marketing, promoting, demonstrating, or operating the Services. You grant Scholastia permission to use your name, likeness, voice, and image in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Services, your Submitted Content, or Scholastia’s content, and you waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.

5. Pricing

The final price of a course is set by Scholastia. Educators do not possess any control over setting the fee for an online course.

6. Revenue Share

By participating in Scholastia, you agree that for each collection, your revenue share will be calculated as follows:

  1. Educators will receive 25% of the net course fee (‘net course fee’ refers to the fee left after excluding applicable GST, payment gateway charges and/or any additional expenses involved) of an online course. For example, if a course is listed for INR 3000 on our website, excluding applicable 18% GST and 2.36% payment gateway charges and/or additional involved expenses, the educator will be entitled to receive INR 616.84 per sale made on that particular course.

7. Payments

  1. After formally registering as an educator, you will gain access to your very own instructor dashboard. There under “Settings” you will find the option “Withdraw” where you can enter and save your bank details.
  2. For us to pay you in a timely manner, you must own a RazorPay, UPI, GPay, Paytm, PhonPe, or Indian bank account (for Indian residents only) in good standing and must keep us informed of the correct email associated with your account.
  3. When a student purchases your Submitted Content, we calculate the gross amount of the sale as the amount actually received by Scholastia from the student (“Gross Amount”). From this, we subtract any Sales Taxes to calculate the net amount of the sale (“Net Amount”).
  4. Scholastia makes all instructor payments in Indian Rupees (INR) regardless of the currency with which the sale was made. Scholastia is not responsible for your foreign currency conversion fees, wiring fees, or any other processing fees that you may incur. Your revenue report will show the sales price (in local currency) and your converted revenue amount (in INR).
  5. Depending on the applicable revenue share model, payment of one month – in which (a) we receive the fee for a course or (b) a course sale is recorded – will be made within the 5th day of the following month. E.g., if your course begins to sell from the first week of June, the total amount of revenue generated till the 30th day of June will be credited to your account within the 5th day of July; however, if your course starts to sell in the last week of June, only that last week’s recorded revenue will be credited to your account within the 5th day of July (from then on, every full month’s revenue will be regularly released within the following month’s 5th day).

8. Use of Company Logo and Trademarks

You must:

  • only use the images of our company logo that we make available to you, as detailed in any guidelines we may publish;
  • only use our logo in connection with the promotion and sale of your Submitted Content available on Scholastia or your participation on Scholastia; and

You must not:

  • use the CA Worldwide Course Accreditation logo and the CPD Index logo separately for sale of your course on anywhere other than Scholastia’s very own platform;
  • use our logo in a misleading or disparaging way;
  • use our logo in a way that implies that we endorse, sponsor, or approve of your Submitted Content or services; or
  • use our logo in a way that violates applicable law or in connection with an obscene, indecent, or unlawful topic or material.

9. Account and Course Deletion

  • Account Deletion:
    Educators may request the deletion of their account at any time by contacting platform support. Once an account is deleted, all associated data, including course materials, user interactions, and any content uploaded by the educator, will be permanently removed. Please note that account deletion is irreversible and may affect the educator’s ability to access previously published courses or any historical data linked to the account.

  • Course Deletion:
    Educators have the right to request deletion of individual courses they have created. Upon deletion, the course and all related content will be permanently removed from the platform. It is the educator’s responsibility to back up any important materials before proceeding with course deletion. Deleting a course may also affect any enrolled students, who will lose access to the course and its content.

  • Platform’s Right to Delete:
    The platform reserves the right to suspend or delete an educator’s account and/or course(s) for violations of the platform’s policies, including but not limited to content that is unlawful, violates intellectual property rights, or breaches the platform’s community guidelines. Educators will be notified prior to any deletion action, except in cases of severe violations where immediate action may be required.

  • Data Retention:
    In compliance with applicable laws, the platform may retain certain data even after account or course deletion for legal, regulatory, or operational purposes, such as billing information or records of transactions.

  • Reactivation of Account or Course:
    Once deleted, accounts or courses cannot be reinstated. If an educator wishes to return to the platform, they must create a new account and upload new course materials.

Other Legal Terms

These Terms are similar to any other contract in that they contain boring but necessary legal terms that secure us from a variety of potential calamities and specify the legal connection between us and you.

Legal Binding Contract

You agree to engage in a contractual agreement with Scholastia by registering, or using our services.

Disclaimers

Our platform may be unavailable due to planned maintenance or a technical issue with the site. It’s also possible that we’ll run into security difficulties. These are only a few instances.

Compensation

We may take legal action against you if you act in a way that puts us in legal trouble.

Jurisdiction and Governing Law

When these Terms relate to “Scholastia,” they’re referring to the Scholastia entity with which you’ve entered into a contract. If you’re a student, your legal entity and governing law are usually defined by where you live.

Our Relationship

We concur that we do not have a partnership, alliance, employment, contractor, or agency relationship.

No Assignment

These Terms may not be assigned or transferred (or the rights and licenses granted under them). For example, if you created an account as a firm employee, you won’t be able to switch your account to another employee. Without limitation, we may assign these Conditions (or the rights and licenses granted under them) to another firm or person.

No right, advantage, or remedy is conferred on any third-party person or entity by these Terms. You acknowledge that your account is non-transferable and that upon your demise, all rights to your account and other privileges under these Terms will be terminated.

Revising Terms

We may revise these Terms from time to time to explain our practices or to address new or different practices (for example, when we add new features), and Scholastia maintains the right to alter and/or change these Terms at any time in its sole discretion.

If we make a significant change, we will inform you in a prominent way, such as an email notification. Unless otherwise specified, changes will come into effect the day they are posted.

If you continue to use our Services after the changes are implemented, you are agreeing to the changes.

Miscellaneous Terms

  1. From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Scholastia reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.
  2. Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
  3. Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.

By reading the abovementioned terms and while registering as an educator/instructor on Scholastia, you acknowledge and agree to the terms and conditions outlined in this agreement.
